The first article of impeachment against Department of Homeland Security Secretary Alejandro Mayorkas was ruled unconstitutional by the Senate on Wednesday in a party-line vote.
The first of two articles of impeachment accused Mayorkas of engaging in a “deliberate and systemic failure to comply with the law” regarding the southern border in his capacity as DHS secretary.
Majority Leader Chuck Schumer, D-N.Y., proposed a point of order declaring the section unconstitutional, to which the majority of senators agreed after several motions were rejected by Republicans.
The section was ruled unconstitutional by a vote of 51-48, with Sen. Lisa Murkowski, R-Alaska, present.
